Regulations

1. DEFINITIONS

The following terms have the meanings agreed upon in the lines below throughout this document, unless otherwise expressly defined within the document:
TICKET or subscription, individual or group: a document issued in digital or paper format, which certifies the right of access of a person or group of people to one or more events within the festival for a limited number of days. Tickets have a unique identification number and are non-nominal.
ACCESS BRACELET: a badge applied by the Organizers after ticket validation, which certifies that its bearer has the right to visit one or more festival locations, on one or more days, according to the rights offered by the ticket.
TICKET BUYER: natural person who purchases one or more tickets and/or access passes to the festival.
FESTIVAL DURATION: the duration of time between the beginning and the end of the festival as publicly communicated through the website www.jazzinthepark.ro.
EVENT DURATION: the duration of time between the beginning and end of the events and concerts within the festival as they are publicly communicated on the website www.jazzinthepark.ro.
THE FESTIVAL: all concerts, actions, programs, performances and other services organized by Jazz in the Park for a certain duration and in one or more clearly mentioned places during the festival.
VENUE: any of the spaces/areas where the Festival activities take place as mentioned in the specific section of the website www.jazzinthepark.ro.
ORGANIZER/II: the association of legal entities that organize and stage the Jazz in the Park Festival, having exclusive rights over it. The Jazz in the Park Festival is co-organized by the Fapte Association (Str. Donath, no. 192, block A4, ap. 12, Cluj-Napoca, CIF 31425230) and Fapte Muzicale SRL (Calea Floreÿti, no. 2, bl. A1a, ap. 5, Cluj, CIF RO 35410470).
COMMERCIAL PARTNER: natural/legal persons or association of natural/legal persons who carry out an independent commercial activity, authorized according to law, within the Festival, based on a contractual relationship with one of the Festival Organizers.
PARTNER: natural/legal person or association of natural/legal persons who collaborate with one of the Organizers in order to carry out a cultural, commercial, promotional action or any other type of action mutually agreed upon based on a contractual relationship within the Festival.
PARTICIPANTS: all persons participating in the Festival based on an access ticket or invitation.
UNAUTHORIZED PARTICIPANTS: all individuals who are at any time in the venue of the Festival during its duration, without having a legal right of access or who have acquired this right illegally through methods such as, but not limited to: forging a ticket or an access bracelet, purchasing a ticket or an access bracelet from Merchants not authorized by the Organizer.
PRODUCT: the elements and rights with monetary value that can be purchased from the Organizers or from the Organizer’s Partners and Commercial Partners within the Festival or in connection with it.
SERVICE: any service made available or purchased from the Organizers or from the Organizers’ Partners and Business Partners or in connection therewith.
THIRD PARTIES: natural/legal persons other than the Organizers, Partners, Commercial Partners, Participants, Buyers, Donors or Visitors of the Festival.
VISITORS: natural/legal persons who have the right to participate in the Festival, other than Participants, such as but not limited to Volunteers, representatives of Commercial Partners, representatives of suppliers, the organizing team or any other Third Party present at any given time at the venue of the Festival during its duration and who holds a valid right to participate in the Festival.
REGISTERED VOLUNTEER: person who completes the registration form as a Volunteer within Festival.
VOLUNTEER PARTICIPANT: natural person over 16 years of age who, after completing a valid registration form, was selected to participate as a Volunteer at the Jazz in the Park Festival.
WEBSITE: the Festival website, namely www.jazzinthepark.ro.


2. GENERAL TERMS AND CONDITIONS

a. These regulations establish the terms and conditions of participation in the Jazz in the Park Festival 2025.
b. By participating in the Festival, Participants, Volunteers, collaborators and any Third Parties who interact directly and indirectly with the Festival accept and agree to the terms and conditions of these Regulations.
c. By purchasing tickets, Buyers undertake to comply with the Regulations, the rules of access to the Festival as well as any other rules of participation in the Festival that are brought to their attention through online or offline means of communication.
d. The content of these regulations is the property of the Organizers of the Jazz in the Park Festival, namely Asociația Fapte și Fapte Muzicale SRL.
e. The Jazz in the Park 2025 Festival is managed by Asociaÿia Fapte as Organizer and Fapte Muzicale as co-organizer. Asociaÿia Fapte is a non-profit legal entity, headquartered in Cluj Napoca, Str. Donath no. 192, block A4, ap. 12, jud. Cluj with CIF 31425230. Fapte Muzicale SRL is a legal entity, headquartered in Cluj Napoca, Calea Floreÿti, no. 2, bl. A1a, ap. 5, Cluj County, with CIF RO35410470.


3. PERIOD AND VENUE OF THE FESTIVAL

a. The Jazz in the Park 2025 Festival takes place between June 6 and June 8, 2025 in the “Romulus Vuia” Ethnographic Park, Tăietura Turcului fn Street, Cluj Napoca. b. The program of events in the aforementioned Festival space will be communicated by the Organizer on its own communication channels and in the media no later than 10 days before the event.
c. The organizer reserves the right to change the venue of the events. In case of such changes, the purchased tickets will remain valid for the new venue of the event.
d. The Organizer reserves the right to supplement the Festival venues.


4. ACCESS TO THE FESTIVAL

a. Tickets and ticket types
There are 3 types of tickets available during the Festival, as follows:
One-day ticket – grants the Participant the right of access to the “Romulus Vuia” Ethnographic Park to all events, concerts and activities held between 14:00 and 23:59 for the day for which it was purchased.
Subscription tickets – give the Participant the right of access to the “Romulus Vuia” Ethnographic Park location to all events, concerts and activities held between 14:00 and 23:59 on each day of the Festival in which the location is active.
Access for children up to and including 12 years of age is free if they are accompanied by at least one adult holding a valid Festival ticket.
TICKET SALES
i. Tickets and subscriptions can be purchased online on the www.iabilet.ro
platform.
ii. Tickets and subscriptions to the Festival are sold through the Organizer’s Commercial Partners and not directly by them. Payments regarding the purchase of tickets are made through the Commercial Partners in compliance with their Terms and Conditions.
iii. The final price of the ticket includes administration and processing fees, Red Cross stamp duty, stamp duty for historical monuments, fees related to collective management bodies. The Organizer does not assume responsibility for administration and processing fees that may differ depending on the Commercial Partners from which the ticket is purchased. In this regard, the Organizer recommends that before purchasing a ticket, the Terms and Conditions section of the Commercial Partner from which the ticket is purchased be checked.
iv. Ticket sales will be stopped when a ticket category is sold out. The organizer reserves the right to supplement the number of tickets and put them on sale, if the capacity of the location allows it. v. Tickets purchased cannot be replaced, and their value cannot be refunded.
vi. The organizer reserves the right to change the price of tickets without prior notice. The price of the ticket is the one displayed at the time of its purchase on the platform.
b. Invitations
Invitations and/or tickets with a value of 0 lei grant holders the same rights as holding an access ticket. There are 2 types of invitations available at the Festival:
• One-day invitations – grant the Participant the right of access to the “Romulus Vuia” Ethnographic Park to all events, concerts and activities carried out during the specified time slot for one day of the Festival.
• Subscription invitation – grants the Participant the right to access all events, concerts and activities held during the specified time period each day of the Festival.
c. Access for people with disabilities
i. In the case of people with disabilities classified in a handicap category, they and their companions benefit from the following facilities within the limit of 100 subscriptions for the 3 days of the festival:
• Disabled children and their companions benefit from a free subscription for the 3 days of the festival.
• Adults with severe and pronounced disabilities and their companions benefit from a free subscription for the 3 days of the festival.
• Adults with moderate or mild disabilities – do not benefit from free admission, but can receive tickets at a reduced rate of 299 lei.
ii. To benefit from free admission, adults with disabilities (or in the case of minors, their legal representatives) must complete the form here: www.jazzinthepark.ro. If people with disabilities will benefit from a subscription for the 3 days of the festival, they will receive an e-mail from the Organizer to this effect. These people are subsequently required to present the original disability certificate and identity card at the access point mentioned in the confirmation email received for verification.
iii. Free access for people with special needs is made only on the basis of the identity document, the disability certificate and the confirmation received by e-mail from the Organizer.
iv. Incomplete applications and/or applications sent to other e-mail addresses will not be taken into account.
v. The Organizer reserves the right to deny access to the festival to persons with disabilities who do not present these documents in original. If the Organizer’s representatives have justified doubts regarding the validity or authenticity of the documents presented, the Organizer reserves the right to make the necessary checks and deny access to the person.
vi. The registration period to benefit from the free entry for the 2025 edition is 01.03.2025-01.05.2025. All applications sent outside this period will not be considered.
vii. Taking into account that this facility can only be granted within a limited number of places, considering the total capacity of the Festival as well as the safety and security norms, the free admission will be granted according to the order of receipt of requests. viii. At the time and to the extent that the number of 100 requests that comply with the conditions specified above is reached, the Organizer will display in these Regulations that the maximum number of tickets granted free of charge for people with disabilities has been reached, and from that moment the Organizer will no longer respond to requests addressed in this regard.
ix. The Organizer will respond to these requests within 10 days from the date of the requests.
x. People with severe disabilities assume the obligation to always come accompanied to the Festival, for reasons of personal safety.
xi. The organizer recommends that all minors and people with disabilities come accompanied to the Festival.
xii. The organizer will not be held responsible for any incident or accident involving minors or disabled persons. The entire responsibility for these rests with the minors/disabled persons and/or their parents/legal representative or companion.
d. Exchange of tickets, subscriptions and invitations into access bracelets i. Exchange of the access ticket, subscription, group ticket or valid invitation to the Festival into an access bracelet is conditional on the completion of the access formalities to the Festival according to the provisions of Art. 4.d. of these Regulations.
ii. The access bracelet grants the holder the rights and obligations similar to the access ticket. iii. The access bracelets will have distinct colors and insignia depending on the age of the Participants and the type of ticket purchased, granting the Participants different rights (e.g. the right of adults to purchase alcohol and tobacco).
iv. Participants and Visitors are required to wear the bracelet on their hand, in a visible place, for the entire period of its validity, as well as for the entire period in which they are in one of the event locations.
v. The Organizers reserve the right to verify the integrity of the access bracelets at the entrance and whenever they deem necessary within the Festival perimeter, in all locations and throughout the duration of the Festival.
vi. The loss, damage or destruction of the bracelet is the exclusive responsibility of each Visitor or Participant at the Festival.
vii. In case of damage or loss, the bracelet no longer offers the Participant any rights, being obliged to purchase a new ticket or leave the event location.
viii. The Organizers will not exchange broken, unstitched or glued bracelets, as these are considered invalid.
ix. In well-justified cases, Participants and Guests may present themselves at the Info Point for the replacement of a valid wristband (which is not damaged, torn, sewn, etc.) by presenting the access ticket. Such situations include, but are not limited to: the wristband was tightened too tightly, the color of the wristband does not correspond to the type of ticket purchased, etc.
e. Access to the venue
i. Access to the event is by scanning the ticket, either printed or in electronic format, from the Participants’ mobile devices.
Access is only possible based on a ticket valid for the day or a subscription for events within the venue.
ii. For safety reasons, access to the event begins 60 minutes before the start of the first concert and will be phased. Please allow sufficient time to complete the access procedures. iii. If you leave the event space, re-entry to the venue is only allowed based on an access bracelet valid for the current day and the venue in question.
iv. Entry and exit to/from the event space is through specially arranged places. Please respect the entry/exit flows according to the markings and maintain distance when entering/exiting the event space.
v. In order to ensure the orderly and safe conduct of the events, the Organizers reserve the right to restrict the objects and devices that can be brought into the Festival area.
Access to the Festival area with the following objects is prohibited:
• Pyrotechnic items.
• Knives, weapons and other blunt objects.
• Drugs.
• Flammable or explosive materials.
• Any type of object that may injure other Participants.
vi. Participants assume responsibility for the objects they possess and introduce into the Festival perimeter. The Organizers reserve the right to check Participants, by random inspection or as a result of suspicions identified by the Organization team and/or the security and protection team, and to confiscate any prohibited objects identified. In the event of incidents as a result of possession of any of the previously mentioned objects, their owners assume exclusive responsibility for them. vii. Access with pets is allowed provided that the regulations regarding pets in public spaces are respected (animals will be kept on a leash, large dogs or aggressive breeds must wear a muzzle, etc.).
If the Participants at the event do not comply with the rules regarding pets, the Organizers reserve the right to refuse access to people and pets to the event, respectively to remove them from the event, the Festival perimeter, persons who are found violating these rules during any activity within the event.


5. GENERAL RULES OF CONDUCT DURING THE EVENT

a. Event participants are required to demonstrate appropriate behavior for public events.
b. Event participants are required to refrain from any actions, statements or behaviors that may endanger their life, health or physical integrity or that of other participants.
c. Any form of marketing or advertising campaigns within the event area is prohibited without the prior written permission of the Organizers.
d. Any demonstration or manifestation of any nature that is not related to the event and the Organizers and that has not been previously approved in writing by the Organizers is prohibited.
e. Participants expressly understand and accept that, by virtue of their participation in the event, they will fully cooperate with the Organizers, the technical team, representatives of security and first aid services, as well as any other public or private authorities involved in organizing the event and will comply with their instructions during the event, in the event of emergency situations or when other circumstances require it.


6. EVACUATION OF THE EVENT SPACE

a. The evacuation of the venue space will be carried out starting from the moment of the completion of the last concert on the day and at the respective location, gradually in each of the Festival areas. b. Please follow the instructions presented on site regarding the evacuation order provided by the Organizers.


7. CANCELLATION OF TICKETS AND RETURN OF THEIR AMOUNT

a. Purchased tickets/subscriptions cannot be cancelled or exchanged.
b. The value of the tickets is not refundable in the following situations:
i. In the event of adverse weather conditions.
ii. The value of the tickets is not refundable if the access of the ticket holders is denied by the Organizers for justified reasons and related to the safety of the other Participants in the event.
iii. In the case of group/family tickets, the total or partial value of the tickets is not refunded if the number of participating people is less than the maximum number of people allowed according to the ticket type.
iv. The value of tickets for one day of the Festival is not refundable in the event of a change in the artists announced at the time of ticket purchase. The tickets provide the Buyer with access to the Festival venue and not to a specific concert.
v. The value of unused tickets from the subscription package is not refundable.


8. RIGHTS AND OBLIGATIONS OF PARTICIPANTS

a. Participants are obliged to comply with these Regulations throughout the entire period of the event and in all its locations.
b. Participants do not have the right to use the event space for carrying out illegal activities or
activities that endanger in any way the safety of other Participants in the event.
c. Participants are prohibited from distributing, modifying or copying, displaying, reusing, reproducing, publishing, creating derivative works, transferring, selling or using the content of the event or these Regulations without the written consent of the Organizers.
d. Participants are obliged to immediately communicate to the Organizer’s representatives or the security team any situation that they have good reason to report as representing a danger to the security of other Participants during and within the perimeter of the event.
e. Participants are obliged to cooperate with the Organizers and representatives of security and health services, with the competent authorities, with the Volunteers to ensure the smooth running of the event, to avoid situations that could endanger the security of the Participants or to remedy such situations as soon as possible.


9. RIGHTS AND OBLIGATIONS OF THE ORGANIZERS

a. The Organizers have the right to modify, supplement, withdraw, temporarily or permanently these Regulations with or without prior notice to users, potential users or any Third Party. All changes enter into force upon their publication on the website www.jazzinthepark.ro.
b. The Organizers may investigate any action likely to violate these Regulations and issue warnings, suspend, restrict or share access to the event of any Participant, Volunteer, Partner or any other Third Party present in the event during its duration.
c. The Organizers do not assume responsibility for the objects that Participants, Visitors, Volunteers, Partners and Third Parties introduce into the perimeter of the event during its duration.
d. The Organizers reserve the right to check Participants and Visitors, by random sampling or as a result of suspicions identified by the Organization team and/or the security and protection team and to confiscate any prohibited items identified. In the event of incidents as a result of possession of some of the aforementioned objects, their holders assume exclusive responsibility for them.
e. The Organizers do not assume responsibility for the Participants’ belongings, for their loss, damage or theft.
f. The Organizer reserves the right to modify the list of artists participating in the Festival, both previously and throughout the duration of the Festival.
g. The Organizer reserves the right to modify the maximum capacities of the Festival locations in accordance with the safety regulations in force.


10. INTELLECTUAL RIGHTS

a. Photographs, artistic and organizational concepts, internal working procedures and the like (information, data, images, texts, symbols, graphics, web design elements, programs and the like) are the property of the Organizers and are protected by Law no. 8/1996 on the protection of copyright.
b. The use of any of the aforementioned elements, as well as any other similar elements that can be assimilated to copyright, without obtaining prior written consent from the Organizers is punishable by law.
c. The total or partial reproduction, modification, transfer, distribution, republication, copying in part or in whole of the event content is not permitted without the prior written consent of the Organizers.


11. PHOTO-VIDEO RECORDING OF THE EVENT

a. The organizer reserves the exclusive right to the photo and video images from the event.
b. Participants and Visitors understand and accept that the Organizers, Commercial Partners, authorized suppliers of the Organizer, members of the press and other Third Parties authorized by the Organizers may make audio, video and photo recordings of the event.
c. The Organizer may use photo and video images, taken by its own employees, its service providers, Commercial Partners and other authorized Third Parties in various materials made on the occasion of the event.
d. Participants and Visitors, by virtue of their participation in the event, grant the Organizer and all those authorized by it express permission to record and publish their image, appearance and actions within the event on the event perimeter. of him.
e. The Organizers and Third Parties authorized by them have the unrestricted right to use, copy, publish, make public, broadcast and distribute, especially for the purpose of promoting the project, but not only, the recordings, images and photographs taken with the Participants at the event, without having to pay the latter any remuneration for their use.
f. The Organizers reserve the right to record the event directly or through authorized Third Parties, to copy, distribute, broadcast or make public in any way and by means of data transmission or by electronic means, including for the promotion of the project.
g. The Participants and Visitors do not have the right, within the limits of the legal provisions, to raise financial or any other claims against the Organizers in connection with the photo – video recordings and their publication according to those provided for in these Regulations.
h. The Participants have the right to make audio/photo/video recordings of the event for personal use. The Participants do not have the right to sell the images/photo – video recordings from the event without the prior consent of the Organizers.


12. REUSABLE CUPS

a. The Organizers use a system of reusable glasses for the sale of beer and cocktails at all their own points of sale, those of Commercial Partners or other Third Parties authorized to carry out activities of selling alcoholic beverages in the perimeter of the Festival during its period. b. The glasses circulate in a guarantee system between the Organizers’ Commercial Partners and the Participants.
c. The guarantee charged for the use of reusable glasses is 10 lei/piece. The guarantee will be highlighted by the Commercial Partners separately on the tax receipt according to the provisions of art. 286 para. (4) let.
d) of the Fiscal Code. d. The return of the glasses is made only on the basis of the tax receipt proving the purchase of the glasses. The return of the cash deposit is made only at the return points specially arranged by the Commercial Partners within the festival perimeter. The returned deposit is 10 lei/glass. The return of glasses is made without a fiscal document, according to the provisions of art. 286 paragraph (4) letter d) of the Fiscal Code.
e. The return of glasses cannot be made in the bars of the Organizer or its Commercial Partners.
f. The maximum number of glasses with which a person can return is 5 glasses.
g. Once purchased, a reusable glass can be used whenever during and within the Festival perimeter, without paying any additional guarantee. h. When purchasing a drink, when the Participant already owns a reusable glass, it will be exchanged for a clean glass at the points of sale of alcoholic beverages within the Festival managed by the Organizers or their Commercial Partners.
i. The Organizers, Commercial Partners and any other Third Parties authorized to sell alcoholic beverages in reusable glasses do not assume responsibility for the loss, damage or theft of reusable glasses in the possession of the Participants.
j. Participants are encouraged not to throw reusable cups in the waste collection bins, even if they no longer need them and do not wish to recover their paid deposit. In this case, Participants are encouraged to bring them to any of the points of sale of alcoholic beverages of the Organizers, Commercial Partners or any other Third Parties authorized to sell alcoholic beverages within the festival perimeter.


13. OTHER INFORMATION

a. Suggestions and complaints Participants, Visitors, Volunteers, Partners and Third Parties may send suggestions or complaints to the Organizers at any time by email to salut@fapte.org.
b. Lost and found items
• Lost and found items can be brought to the Festival Info Point, where the owners will be able to recover them within 48 hours, but no later than 12:00 of the following day after the end of the Festival.
• The Organizers do not assume responsibility for the Participants’ belongings, for their loss, damage or theft.


14. LITIGATIONS

a. These Regulations, as well as any dispute related to or arising from their clauses or from participation in the event, will be resolved by Participants, Volunteers, Partners, Third Parties and Organizers amicably.
b. If this is not possible, the resolution of conflicts is within the competence of the Romanian courts in the locality where the Organizers have their registered office
c. By purchasing a ticket/subscription, by participating in events organized by Jazz in the Park or by accessing Jazz in the Park branded communication channels, in particular the website www.jazzinthepark.ro, Visitors and Participants confirm that they have read, understood and accepted these Regulations.


15. LIMITATION OF LIABILITY

a. Participants understand and agree that they participate in the Jazz in the Park 2025 events at their own risk. The Organizers, Fapte Association, collaborators, Partners and Commercial Partners of the Organizers cannot be held liable for direct or indirect damages resulting from access to the event area or the use of the services made available within its area, such as, but not limited to: material damage, loss of data or programs, financial damage, etc.
b. The Organizer does not assume liability for acts committed by persons under 18 years of age participating in the Festival, as it has no legal obligation to supervise minors. The Organizer is not liable for damages of any nature caused by persons under 18 years of age by Third Parties, including but not limited to Festival Participants.
c. Information on events, activities, concerts, artistic manifestations organized, hosted or promoted by the Organizers is provided for informational purposes only and should not be considered as a contractual offer of services provided by the Organizers. Participants understand and agree that this event content is presented without any warranty of any kind.
d. The Organizers make every effort to ensure that the information presented on the website, on social media channels, in the press and through other means of public information is correct and up-to-date. If any errors are reported, the Organizers will try to correct them as soon as possible.
